The hearing planned for December 17th to decide whether the vacancy of S 21.5 Road should be remanded back to the County Commissioners has been cancelled. This cancellation reflects the judges decision, after meeting with the legal team of the private land owners that requested the vacancy, that it would be against state law to reverse the vacancy decision. This decision effectively limits any recourse for the citizens who feel this vacancy decision was made without proper involvement by the community to regain public access to the trail. The citizen’s group fighting the decision are considering a lawsuit which is their final option.
